The Seven Privacy Sins

Most of the fear associated with student privacy centers around the ‘hacker’ and the ‘marketer’ as unknown forces stealing information and using it for their own benefit.  </div>

However, privacy risks are often much closer to home and exist even within the trusted environment of a classroom.  An app or website that improperly measures or inappropriately shares student performance could trigger humiliation, unfair treatment, or doom a student to years of improper categorization. </div>

Much of the discussion around student privacy is laden with jargon, references to legislation, and quite academic.  This type of discussion makes it hard to actually implement in schools as it seems far-removed and impractical. </div>

Hence, we at Student Data Privacy Services have created a unique model – called the Seven Privacy Sins – to translate the complex concepts of student privacy into something more human and practical. </div>

K12 Schools: The Privacy Legal Landscape

For many years pretty much the only student privacy laws that schools had to be concerned with were the big two; FERPA (Family Education Rights & Privacy Act) and COPPA (Children’s Online Privacy Protection Act). Two others, PPRA (Protecting Pupil Rights Amendment) and certain provisions of HIPAA (Health Insurance Portability & Accountability Act), while applicable, have narrower in their application.<br />
<br />
In 2014 <a href="http://in%202014%20more%20than%20120%20laws%20were%20proposed%20in%20state%20legislatures/" target="_blank">more than 120 laws were proposed</a> in state legislatures intended to regulate a broad range of student data collection and use practices. As a result, a number of states are now implementing new laws, with California’s <a href="https://cdt.org/blog/california-takes-meaningful-step-toward-shoring-up-student-privacy/" target="_blank">SOPIPA</a> (Student Online Personal Information Privacy Protection Act), the most significant and perhaps influential. Already in 2015 more than 130 student privacy laws have been proposed in states, proposals similar to California’s SOPIPA common. Then of course the really big news in privacy legislation is President Obama’s <a href="http://www.edweek.org/ew/articles/2015/01/21/obama-calls-for-stronger-protections-on-student-data.html" target="_blank">Student Digital Privacy & Innovation Act</a>.<br />
<br />
A common refrain by many of those outspoken on privacy is that we need to go beyond compliance, yet with little or no specifics as to what that means. The problem with this, is that it can imply that compliance is really easy or not that important in the grand scheme of things. Of course, neither is true. FERPA and COPPA alone can be quite confusing when it comes to implementation. So when I say we need to “go beyond compliance,” I mean that, let’s not focus so narrowly on compliance that we lose sight of some key issues that privacy laws are often intended to address.<br />

There are 4 key issues that many student privacy laws address:<br />
<br />
<ul>
<li>Schools need to maintain control over student data, wherever the data is located. This includes having explicit agreements with 3rd party service providers about how student data is to be secured, managed, shared and retained.</li>
<li>Parents of K12 students have a right to access data contained in the educational records of their students. In addition to access rights, parents have the right to seek corrections when inaccuracies are found.</li>
<li>Online service providers must be explicit about what data they will collect, how they will use it and, if applicable, will the data be shared with others and for what purposes. Commercial use of data is of particular concern.</li>
<li>Service providers have an obligation to obtain consent from parents for collecting personal information about their students when using their services/applications. In some cases school officials may provide consent on behalf of parents.</li>
</ul>

By focusing on these four issues, you will not necessarily ensure compliance, but you will be going a long ways towards addressing some of the more significant privacy concerns. It’s true that good intentions alone are not enough, but failing to do anything because you are mystified by privacy laws is also not the answer.<br />
<br />
The key takeaway here is to not let the confusing privacy laws and changing legal landscape get in the way of implementing practical steps to protect student data. There are many outstanding resources that you can refer to for compliance guidance. I mentioned these in my previous post, but they bear repeating. CoSN’s (Consortium for School Networking) <a href="http://www.cosn.org/privacy" target="_blank">Protecting Privacy in Connected Learning</a> toolkit, the US Department of Education’s <a href="http://ptac.ed.gov/" target="_blank">Privacy Technical Assistance Center</a>, and <a href="http://www.k12blueprint.com/privacy/" target="_blank">K12 Blueprint’s privacy toolkit</a> are all great resources. And just as you do for other technical services, consider turning to service providers who have expertise in privacy compliance. There is no reason that you have to go it alone on this difficult issue.<br />

The Practical Guide to K12 Student Data Privacy

Just a couple of years back, the issue of student data privacy was hardly mainstream. That’s all changed dramatically due to the many data breaches and controversial programs, such as inBloom, dominating the conversation in education technology media.  At the same time, I think there is now a greater appreciation not only of the potential data privacy risks, but the inherent importance of protecting the privacy of students. Given all of the attention that has been given to the issue of student data privacy, it is not surprising that privacy guidance resources, toolkits and advice have proliferated.<br />
<br />
But many of those who must grapple with the student data privacy issue are still confused. The Federal laws seems so intricate and states are barraging schools with even more laws. To make matters more confusing, the all-too-common catch-phrase that schools “need to go beyond compliance” seems to suggest that compliance is easy and that schools need to do more. Yet to most of us, mere compliance seems a daunting task. What’s a district leader to do?<br />
<br />
District technology leaders need practical, simply-stated advice and concrete steps that they can take to deal with the privacy issue. That’s where <a href="http://www.studentdataprivacy.com/" target="_blank">Student Data Privacy Services</a> comes in. They have asked me to write a series of posts for district technology leaders that will help guide them through the privacy maze. In this first of eight posts, I’m providing an overview of coming posts so that readers can have a sense of the larger issue. While a thick tome could likely be written about each issue, my goal is to provide plain-spoken, digestible guidance. You’ll find the same tone in my many analyst reports and blogs found on <a href="http://www.k12blueprints.com/" target="_blank">K12Blueprints.com</a>.<br />

I’ll be drawing upon and referring to many of the good resources that are already available, but it may seem like too much to wade through. Resources such as CoSN’s (Consortium for School Networking) <a href="http://www.cosn.org/focus-areas/leadership-vision/protecting-privacy" target="_blank">Protecting Privacy in Connected Learning toolkit</a>, the US Department of Education’s <a href="http://ptac.ed.gov/" target="_blank">Privacy Technical Assistance Center</a>, and K12 Blueprint’s privacy toolkit are great resources, but it is easy to get lost in their intricacies and/or sheer volume. My goal is to simplify to the extent that I can, while still keeping within the spirit of legal requirements. Much like I did in <a href="http://www.k12blueprint.com/student-data-privacy" target="_blank">Making Sense of Student Data Privacy</a>. Some may argue that over-simplification is dangerous, but I would counter that it is far better to simplify, while being true to the spirit and intent of the law, than ignore or avoid the law because compliance seems to daunting.<br />
<br />
As for the topics I’ll cover in the series, I’ll be looking at the issue from two different perspectives: that of the school district and the service providers. I’m approaching it this way because I believe it is important to understand both perspectives. I’ve worked in both worlds and having both perspectives is critical for issues like privacy. Protecting privacy requires a partnership, or collaboration, and that can only be accomplished by understanding the role of the respective parties.  I’ll start by reviewing some of the legal requirements and legal landscape. Next up will be some of the technical issues, particularly as they apply to data security. Then we’ll take a look at the importance of policies and processes for the respective organizations. <br />

district CIO role for many years, before leading global education strategy for
a large technology business. Bob has been long considered a thought leader on
issues important to K12 school system technology leaders. In recent years he
has emerged as a thoughtful, practical voice on student data privacy issues and
leads the Protecting Privacy in Connected Learning initiative for CoSN. In his
